Legal Basis
A National Technical Assessment is a documented, positive assessment of the performance characteristics of those essential characteristics of a construction product which, in accordance with its intended use, affect the fulfilment of the basic requirements referred to in Article 5(1)(1) of the Act of 7 July 1994 – Construction Law, by construction works in which the product is to be used.
Proceedings for the issuance of National Technical Assessments are conducted pursuant to the provisions of the Act of 16 April 2004 on Construction Products and the Regulation of the Minister of Infrastructure and Construction of 17 November 2016 on National Technical Assessments.
National Technical Assessments are issued for products belonging to groups of construction products subject to the obligation to prepare a national declaration of performance, as specified in the Regulation of the Minister of Infrastructure and Construction of 17 November 2016 on the method of declaring the performance of construction products and the method of marking them with the construction mark.

Procedure for the Issuance of a National Technical Assessment
Proceedings for the issuance of a National Technical Assessment are conducted pursuant to the provisions of the Act of 16 April 2004 on Construction Products and the Regulation of the Minister of Infrastructure and Construction of 17 November 2016 on National Technical Assessments.
In accordance with the above-mentioned Regulation:
The Technical Assessment Body, within one month from the date of receipt of the application, carries out a formal assessment and informs the applicant whether there are grounds to initiate the proceedings referred to in Article 9(5) of the above-mentioned Act (hereinafter referred to as “the proceedings”), or provides written justification for the lack of grounds to initiate such proceedings.
The applicant concludes an agreement with the Technical Assessment Body for the conduct of the proceedings.
Unless otherwise provided for in the agreement, within two months from the initiation of the proceedings, the Technical Assessment Body presents the applicant with a written position regarding the application. In its position, the Technical Assessment Body specifies:
-
the type, subject, methods and scope of additional tests, calculations and classifications, together with a concise justification for their necessity,
-
a list and subject of additional documents and information required under separate regulations
– necessary to assess the performance characteristics of the construction product in relation to its intended use.
Obtaining the documents, information, test results, calculations and classifications referred to above is the responsibility of the applicant.
In the proceedings, the Technical Assessment Body recognises the results of tests and calculations performed by:
-
laboratories accredited in accordance with the Act of 13 April 2016 on Conformity Assessment and Market Surveillance Systems;
-
foreign laboratories, where this results from international agreements, and laboratories notified in accordance with Regulation (EU) No. 305/2011 of the European Parliament and of the Council of 9 March 2011 laying down harmonised conditions for the marketing of construction products and repealing Council Directive 89/106/EEC;
-
other domestic and foreign laboratories with which the Technical Assessment Body has concluded agreements on the mutual recognition of test and calculation results.
The Technical Assessment Body may also recognise, in the proceedings, test results and calculations provided by the applicant and performed by domestic or foreign laboratories other than those listed above.
When conducting the proceedings, the Technical Assessment Body:
-
assesses the performance characteristics of construction products, taking into account applicable separate regulations, including technical and construction regulations, as well as scientific principles and practical knowledge;
-
analyses the data received from the applicant in a manner ensuring a balanced assessment;
-
makes impartial decisions;
-
ensures the confidentiality of information obtained during the proceedings and maintains the secrecy of test and calculation results, design documentation and technology descriptions reserved by the applicant.
After obtaining the complete set of test reports, calculations, information and documents specified in its position regarding the application, the Technical Assessment Body issues the National Technical Assessment or refuses to issue it, providing justification for its decision.

A National Technical Assessment is issued, amended or extended at the applicant’s expense. The fee for these activities is calculated, in accordance with Article 9(4) of the above-mentioned Act, based on the product of the hourly rate and the number of working hours required for these activities.
The number of working hours required to issue, amend or extend the validity period of a National Technical Assessment is determined by the Technical Assessment Body, taking into account:
-
the scope of the submitted application and the attached technical documentation;
-
the complexity of the construction product and the applied material and technological solutions;
-
the extent of the use of standardisation documents and other technical specifications in the proceedings;
-
the scope of the intended use in construction;
-
the requirements arising from technical and construction regulations concerning the intended use of the construction product.
When conducting proceedings for the amendment or extension of the validity period of a National Technical Assessment, the Technical Assessment Body applies, as appropriate, the provisions concerning the procedure for issuing a National Technical Assessment.

NATIONAL TECHNICAL ASSESSMENTS
CONDITIONS FOR THE ASSESSMENT OF PERFORMANCE OF A CONSTRUCTION PRODUCT
The conditions for the assessment of performance of a construction product are developed on the basis of § 6(2) and § 7 of the Regulation of the Minister of Infrastructure and Construction of 17 November 2016 on national technical assessments (Journal of Laws of 2016, item 1968), with regard to construction products for which there are sufficient scientific grounds and practical knowledge to determine a uniform scope of the required level of performance characteristics.
The Conditions for Assessment are developed by a technical assessment body/national technical assessment body within the scope of product groups for which it is authorised to issue national technical assessments. In the case of construction products falling within the scope of more than one assessment body, the Conditions for Assessment are developed jointly by those bodies.
The provisions contained in the Conditions for the Assessment of Performance of a Construction Product are taken into account in the procedure for issuing a national technical assessment for a product covered by the Conditions for Assessment.

National Technical Assessments

Is a documented, positive assessment of the performance of those essential characteristics of a construction product which, in accordance with its intended use, affect the fulfilment of the basic requirements by construction works in which the product will be used.
A National Technical Assessment is issued for a construction product:
-
not covered by the scope of a Polish product standard, or
-
if, with regard to at least one essential characteristic of the construction product, the assessment method provided for in the Polish product standard is not appropriate, or
-
if the Polish product standard does not provide for an assessment method with regard to at least one essential characteristic of the construction product.
A National Technical Assessment is issued for a period of 5 years.
This period may be extended for subsequent periods not exceeding 5 years. A National Technical Assessment is valid from the date of its issuance.
