NATIONAL TECHNICAL ASSESSMENT

The Road and Bridge Research Institute appointed as Technical Assessment Body (TAB) and as National Technical Assessment Body (NTAB) issues, amends, extends and cancels national technical assessments for construction products used in transport construction, belonging to the groups* coded as follows:

1. Precast normal/lightweight/autoclaved aerated concrete products,
3. Membranes, including liquid applied and kits (for water and/or water vapour control),
4. Thermal insulation products, composite insulating kits/systems
5. Structural bearings, pins for structural joints,
8. Geotextiles, geomembranes, and related products,
13. Structural timber products/elements and ancillaries,
15. Cement, building limes and other hydraulic binders,
16. Reinforcing and prestressing steel for concrete (and ancillaries), post tensioning kits,
19. Floorings,
20. Structural metallic products and ancillaries
24. Aggregates,
25. Construction adhesives,
26. Products related to concrete, mortar and grout,
28. Pipes, tanks and ancillaries not in contact with water intended for human consumption,
32 Sealants for joints,
33. Fixings,
34. Building kits, units, prefabricated elements,

for construction products used in construction, belonging to groups* designated with the codes:

35. Products for protection against corrosion of metals and biological corrosion,

** according to Annex 1 to the Regulation of the Minister of Infrastructure and Construction of 17 November 2016 on the manner of declaring the performance of construction products and the way of marking them with the building mark (Journal of Laws of 2016, item 1966).

According to Article 9 of the Act of 16 April 2004 on construction products (Journal of Laws of 2016, item 1570, as amended) The Technical Assessment Body may issue a national technical; assessment for a construction product:

1) not covered by the scope of a Polish product standard, or
2) if, in relation to one or more essential characteristics of a construction product, the assessment method provided for in the Polish product standard is not appropriate, or
3) if the Polish product standard does not provide an assessment method for at least one essential characteristic of the construction product.

An application for the issue of a national technical assessment is filed by the manufacturer of the construction product (represented as disclosed in the National Court Register or in the Central Business Register (CEiDG)) or, on behalf of the manufacturer, by its authorised representative, attaching a relevant power of attorney to the application.
The application should be sent to the address of the Road and Bridge Research Institute, ul. Instytutowa 1, 03-302 Warsaw. IBDiM will not accept applications submitted in electronic format.
According to the a/m Regulation, the following should be attached to the application:

1) supplementary details to the technical description of the construction product contained in the application, technical documentation of the construction product, technical drawings, calculations, and other information useful in assessing the construction product performance, if applicable;
2) description of the in-house production control system and related information on the production process;
3) documents confirming performance data of the construction product, including a test and calculation report;
4) information on applicable separate provisions and documents issued pursuant to those provisions, if applicable.

It is the applicant’s responsibility to obtain documents, information, calculations and classifications as well as test results that will be recognised by the IBDiM Technical Assessment Body, provided that they come from:

1) laboratories accredited in accordance with the Act of 13 April 2016 on conformity assessment and market surveillance systems (Journal of Laws of 2016, item 1579);
2) foreign laboratories if this is provided for by international agreements, and laboratories notified in accordance with Regulation (EU) No 305/2011 of the European Parliament and of the Council of 9 March 2011 laying down harmonised conditions for the marketing of construction products and repealing Council Directive 89/106/EEC (OJ L 88, 4.4.2011, p. 5, OJ L 103, 12.4.2013, p. 10, OJ L 157, 27.5.2014, p. 76 and OJ L 159, 28.5.2014, p. 41);
3) other national and foreign laboratories with which the assessment body has entered into an agreement on the recognition of test and calculation results.

The list of accredited laboratories is available on the website of the national accreditation body authorised to accredit bodies assessing conformity under the Act of 13 April 2016 on conformity assessment and market surveillance systems (Journal of Laws of 2016, item 542) – the Polish Accreditation Centre www.pca.gov.pl.

IBDiM does not charge a fee for considering the application. The cost of preparing a national technical assessment is determined pursuant to Article 9 (4) of the Act of 16 April 2004 on construction products (Journal of Laws of 2016, item 1570) – The national technical assessment shall be issued, amended or extended at the applicant’s cost. Payment for those services shall be calculated on the basis of the hourly rate multiplied by the number of hours worked to perform the services.

Having conducted a formal evaluation of the application, IBDiM will send the applicant a contract for the national technical assessment process to be conducted by the technical assessment body, specifying the stages of the national technical assessment procedure in accordance with Article 9 (6) of the a/m Act.

As of the date of entry into force of the Regulation of the Minister of Infrastructure and Construction of 17 November 2016 on national technical assessments (Journal of Laws of 2016, item 1968), the Regulation of the Minister of Infrastructure of 8 November 2004 on technical approvals and organisational units authorised to issue them (Journal of Laws of 2014, item 1040) pursuant to the Act of 25 June 2015 amending the Act on construction products, the Construction Law Act and the Act amending the Act on construction products and the Act on the conformity assessment system (Journal of Laws of 2015, item 1165), as a result of which, as from 1 January 2017, the Road and Bridge Research Institute no longer has the power to grant, repeal or amend technical approvals.

According to the a/m Act, technical approvals issued before the entry into force of Article 1 (5)-(7) of this Act may be used as national technical assessments until the end of the validity period of those approvals.
